Terms & conditions

The below Terms & Conditions and our terms of use apply to any account user placing orders with us.

  1. Contracted Parties

    1. The consumer must be the legal owner or have the owner’s full permission to sell the phone(s) that are sent to us.

    2. Once their phone is received ownership of the phone(s) will pass to us.

    3. Input of details of the phone(s) to be sold by you to us is an offer on the consumer's behalf to enter into a binding contract to sell their phone(s) to us for the purposes of recycling/resale, which we are free to accept or decline at our absolute discretion. Acceptance of their offer and the provision of our services in this regard will commence upon receipt by us of their phone(s) at our warehouse

    4. The consumer may cancel a sale by notifying us in writing (by email) of their intention to do so at any point prior to receipt by us of their phone(s). Thereafter, we shall have commenced the provision of our services to them and are unable to accept any cancellations or return any phone(s) to them after this time.

  2. Your Legal Rights

    1. These terms & conditions do not affect any of the consumer's statutory rights, which cannot be excluded or restricted at law.

    2. We shall not be responsible for losses that result from a failure to comply with these Terms & Conditions, including, but not limited to, losses that fall into the following categories:

      1. loss of income or revenue;
      2. loss of business;
      3. loss of anticipated savings;
      4. loss of data; or
      5. any waste of time

      but shall not prevent claims for foreseeable loss of, or damage to, any physical property or any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

  3. Complaints

    1. If you or the consumer have cause for complaint regarding any service or product provided by the WeBuyAnyPhone.com iframe please email full details to contact@webuyanyphone.com.

    2. We endeavour to respond to all complaints within two working days and aim to resolve any problems as soon as we can after receiving details of a complaint.

  4. Phone Grading

    1. We grade old mobile phones once we receive them by reference to the following categories. It’s important to stick to the guide on the website as incorrect entries will affect the price paid as part of this contract.

      A. Working

      In respect of a full working phone with a battery a full offer price (as detailed on the applicable price list from time to time) will be paid.

      B. Non Working

      Non working handsets (examples of which are set out below) will be graded and paid from a reduced price list. Please note that the examples given below are a non-exhaustive list of defects which will result in a reduced price being paid. We reserve the right to pay such reduced price in respect of any phone(s) which we (acting reasonably) determine to be non-working.

      1. Badly damaged casing
      2. No battery
      3. Handset back/battery cover missing or broken
      4. Does not power up
      5. Handset operating system missing or corrupt
      6. Broken/missing aerial
      7. Faulty keypad
      8. SIM Gate broken or missing
      9. Memory card holder broken or missing
      10. Pin locked
      C. Beyond Economic Repair

      No payment is made for handsets that are beyond economic repair (examples of which are set out below). Please note that such examples are a non-exhaustive list of defects which will result in no payment being made. We reserve the right not to make payment in respect of any phone(s) which we (acting reasonably) determine to be beyond economic repair.

      1. Physically broken
      2. In more than one piece
      3. Broken/Cracked/Snapped hinges
      4. Water damaged
      5. LCD cracked/bleeding/does not work or missing
      6. Unresponsive touch screens
      7. SIM glued in
      8. Memory card glued in
      9. Broken battery terminals
      10. Re-programmed IMEI number
      11. Logged by Immobilise/on the IMEI blacklist register
      12. Barred by a network
  5. Testing

    1. Each mobile phone is tested at our warehouse to ensure the information provided by you is accurate. All phones are tested and recycled in line with ISO 9001 and 14001 procedures

    2. ShP Limited fully adheres to the Waste Electrical and Electronic Equipment Directive (WEEE Directive).

  6. General

    1. If any court or competent authority decides that any of the provisions of these Terms & Conditions are invalid, unlawful or unenforceable to any extent, the provision will, to that extent only, be severed from the remaining term, which will continue to be valid to the fullest extent permitted by law.

    2. If we fail, at any time while these terms & conditions are in force, to insist that the consumer perform any of their obligations under these terms & conditions, that will not mean that we have we have waived such rights or remedies and will not mean that the consumer does not have to comply with those obligations. If we do waive a default by the consumer, that will not mean that we will automatically waive any subsequent default by this consumer. No waiver by us of any of these Terms & Conditions shall be effective unless we expressly say that it is a waiver and we tell the consumer so in writing.

    3. A person who is not a party to these terms & conditions shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

    4. Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you and the consumer accept that communication with us will be mainly electronic. We will contact the consumer by email and, for contractual purposes, they agree to this electronic means of communication and acknowledge that all contracts, notices, information and other such communications that we provide to them electronically comply with any legal requirements that such communications be in writing. This condition does not affect their statutory rights.

    5. All notices given by them to us must be sent to the contact details specified in clause 3.1 of these terms & conditions. Notice will be deemed received and properly served 24 hours after an e-mail is sent or three days after the date of posting of any letter. In proving service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of that addressee.

  7. These terms & conditions and any document expressly referred to in them represent the

    1. The entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
    2. These terms & conditions shall be governed by English law and we both agree to the non-exclusive jurisdiction of the English Courts.

Note: please ensure that the consumer understands these terms & conditions carefully before submitting a consumer's phone(s) for sale to ShP Limited You and the consumer should understand that by submitting their phone(s) for sale to ShP Limited they agree to be bound by these terms & conditions. You should print and keep a copy of these terms & conditions for future reference.
